Chagla holds Governor’s powers not absolute

A Constitution Bench of the Supreme Court, to-day [July 15, New Delhi], began the hearing of the two appeals filed by the State of Punjab against the judgment of the High Court of Punjab and Haryana declaring the two Punjab Appropriation Acts of 1968 including the one relating to the budget for the year 1968-69 unconstitutional. Mr. C.K. Daphtary, Attorney-General of India, arguing for the State of Punjab contended that the Appropriation Acts in question were duly passed by a validly constituted session of the State Legislature. Besides the Chief Justice, Mr. Justice Hidayatullah, Mr. Justice Shah, Mr. Justice Ramaswami, Mr. Justice G.K. Mitter and Mr. Justice Grover were on the Bench.
